1. Purpose and Acceptance
These Terms of Use (ToU) govern access to and use of the HalalStack platform, available at halalstack.app, published on a personal non-commercial basis by Wael Benamor (natural person residing in France). HalalStack is a personal halal asset tracking and information tool (Sharia screening, Zakat calculation, asset valuation). It does not constitute a financial advice service, investment advice within the meaning of Article L.541-1 of the French Monetary and Financial Code, or a personalised Islamic opinion (fatwa). Use of the service constitutes acceptance of these Terms of Use. If you disagree, you must stop using the service.
2. Publisher and Hosting Provider Status (French LCEN art. 6)
HalalStack acts as a publisher within the meaning of Article 6-III of the French Digital Economy Trust Act (LCEN) for its own content (Sharia screening methodology, Learn articles, HCS scoring data, texts written by the HalalStack team). HalalStack acts as a hosting provider within the meaning of Article 6-I-2 of the LCEN for content published by users (comments, community ratings, asset reviews). As a hosting provider, HalalStack benefits from the limited liability regime of Article 6-I-2 LCEN and cannot be held responsible for user content of which it is unaware, provided it acts promptly upon notification of illegal content.
3. Community Rules
The following content is strictly prohibited on HalalStack: insults, defamation, or abuse of a racial, religious or sexual nature; direct buy or sell recommendations for financial securities; price predictions or price targets; trading signals or links to signal groups; manifestly off-topic content (spam, unsolicited advertising); links to third-party websites that infringe third-party rights; copyright infringement; violation of third-party privacy. To report illegal content: signalement@halalstack.app.
4. Notice-and-Takedown Procedure
Any user or third party may report potentially illegal content to: signalement@halalstack.app. HalalStack undertakes to process any notification within 24 business hours. Manifestly illegal content (hate speech, child abuse material, terrorism) is removed without prior notice. Author identification data is retained for 1 year in accordance with Article 6-II of the LCEN. HalalStack may delete any content and suspend any account for breach of these Terms of Use without prior notice or compensation.
5. Exclusion of Tax Liability
Information displayed by HalalStack (Zakat calculations, portfolio valuation, Sharia screening) is provided for informational and religious purposes only. It does not constitute tax advice, investment advice, or accounting services. HalalStack does not calculate your taxable capital gains (art. 150 VH bis CGI), does not generate official Cerfa tax receipts, and does not replace your tax return. Zakat is a religious obligation distinct from taxation. For any tax decision, consult a registered accountant or qualified tax lawyer.
6. Exclusion of Financial Advice
HalalStack provides methodological information on financial assets according to Islamic finance principles. The user remains solely responsible for their investment decisions and bears full responsibility for all their asset management decisions. HalalStack is not a licensed Investment Adviser (CIF) within the meaning of Article L.541-1 of the French Monetary and Financial Code. No obligation of result is assumed. HCS scores and Sharia classifications are methodological information, not personalised investment recommendations.
7. Intellectual Property
The HalalStack Sharia screening methodology (rules R1-R11), the HCS score (Halal Compatibility Score), Learn texts, source code and graphical interface are protected by copyright under Article L.111-1 of the French Intellectual Property Code (CPI) and belong to Wael Benamor. Personal, non-commercial use is permitted. Any reproduction, redistribution, modification or commercial exploitation without prior written consent is strictly prohibited. Any violation may result in civil and criminal proceedings.
8. Applicable Law and Jurisdiction
These Terms of Use are governed by French law. In the event of a dispute not resolved amicably, the Paris Commercial Court shall have sole jurisdiction, subject to mandatory consumer protection rules.
9. Mediation
In accordance with Article L.612-1 of the French Consumer Code, HalalStack undertakes to guarantee the consumer user the right to use a consumer mediator free of charge for the amicable resolution of any dispute. 10. Public Fiqh Compatibility Certificate (Shareable URL)
HalalStack gives users the option to generate a unique public URL displaying their HCS (Halal Compatibility Score, expressed as a percentage) certificate. This feature is strictly optional (opt-in) and is based on double GDPR consent under Art. 6.1.a. Only the user’s first name and initial, the percentage score, and the methodology version are publicly visible. No asset amounts or portfolio details are disclosed. The user may revoke this URL at any time from their settings, with effective purge within 24 hours. 11. Amendments to these Terms of Use
HalalStack reserves the right to amend these Terms of Use at any time. Any material change will be notified by email to active users at least 30 days before it takes effect. Continued use of the service after this notification constitutes acceptance of the new Terms of Use. Users who refuse the new Terms of Use may delete their account from Settings → Account → Delete my account.
